TERMS OF SALE & PRIVACY POLICY

In these Terms of Sale (Terms) "we", "us" or "our" mean Elie Skin ABN: 88 196 959 728 , its successors and assignees, (referred to as "we", "us" or "our") and you, the person, organization or entity that purchases products from us (referred to as "you" or "your"), and collectively the Parties. These Terms apply to all sales made by us to you.

These Terms form the agreement under which we will supply products to you. Please read these Terms carefully. If you have any questions, please contact us using info@elieskin.com. You accept our Terms by making a purchase by ordering from us.

Your acceptance of the Terms indicates that you have had sufficient opportunity to access these Terms and that you have read, accepted and will comply with these Terms and that you are 16 years or older.

Products and Orders:

You may order from us as set out on the website. We may at our discretion accept or reject an order depending on factors including availability of products and our ability to validate payment for the products.

It is your responsibility to check the order details, including product, its ingredients, notes about the product, terms of service and pricing before you complete your order. Upon completion of your order, you will be directed to make a payment on checkout for the product/s you have chosen.

We will provide you with order details, which may include an order number, an order ID, the shipping and billing addresses provided by you to us and a description of what was ordered, when you ordered. Depending upon the availability of stock and clearance of payment, we shall confirm your order by providing you with an order number. A binding agreement comes into existence between you and us once we have given you an order number. No changes to these Terms will be effective unless we both agree to the changes in writing.

Price and Payments:

You agree to pay the purchase price as specified on the Site we invoice at the time that you place your order for the purchase of a product, plus any applicable delivery charges based on the delivery options selected by you. All amounts are stated in Australian dollars. All purchase prices include Australian GST (where applicable). Any delivery charges will be separately shown or advised to you. The price payable will be the advertised price for the product/s.

Following are the payment methods you may choose from: • Credit Cards; or

Debit Cards; or
Elie Skin Gift Cards; or
Afterpay; or
PayPal.

We reserve the right to correct prices of products and/or freight/delivery costs if they have been incorrectly specified on the site. However, such correction shall not affect the order for which the order number has been given.

You must pay for the products either upfront. Your payment will be processed upon receipt of your order. You must not pay, or attempt to pay, for an order through any fraudulent or unlawful means. If your payment is not able to be successfully processed, then your order may be cancelled.

Time for payment for the goods being of the essence, the price will be payable by you at the time of placing the order through one of the methods mentioned earlier.

Availability and Cancellation:

All purchases made with us are subject to availability. We do our best to keep in stock most products and to keep the site and our systems up to date with availability of products.

We may substitute products of the same quality, purpose, and type, as necessary. If this is not possible, we will contact you using the contact details provided by you when you placed the order.
Delivery:

a) Location: Please refer to the delivery information on the Site or with our staff to check that you are in within Australia. Our staff will start delivery process after receiving the confirmation through email from shopify. Please allow us up to two business days for dispatchment.

b) Shipment Cost: A delivery fee will apply, as set out on the Site or notified to you when ordering products from us. However, we offer free standard delivery on all orders over $120.00. The delivery charges may vary from time to time depending upon your location (whether interstate or overseas), variation in the charges of third-party logistical services providers and the delivery service option selected by you. We shall notify you of the applicable delivery charges at the time of you placing your order with us.

c) Timing: Any delivery periods displayed on the Site or notified to you are estimates only, based on the information provided by the delivery services providers. We will deliver the product to the place of delivery you specify when making your order. However, standard delivery normally will take 5-7 business days after dispatchment and express delivery will

take 1-3 business days after dispatchment. Overseas deliveries may take longer than these periods.

d) Method: We may deliver the products via a range of delivery methods. We primarily use Australia Post to deliver you the products. Delivery of the goods is taken to occur at the time that you or your nominated representative takes possession of the goods at the nominated address even if you are not present at the address. If neither you nor your authorised representative is at the delivery address to accept delivery you will be notified, generally by the delivery company leaving a card with contact details, so that you can arrange for the delivery.

Title and Risk:

Title in the products will pass to you once we have placed the products with Australia Post or any other service provider Risk of loss, damage or deterioration to any products will pass to you once the product dispatched to the address you provide. We may provide you with Australia Post tracking number for the products dispatched upon request.

You must not convert or process the products or intermix them with other products, if you do so then you must hold the resulting products on trust for the benefit of us and must sell, dispose of or return the resulting product or proceeds to us as we so direct.
Uncollected Goods

We may dispose of uncollected goods in accordance with the Uncollected Goods Act 1995 (NSW).
Disclaimer in relation to product liability

We recommend you consult a health professional prior to the use of any of our products in terms of its ingredients, your skin susceptibilities such as sensitivity, allergies, allergic reactions and implications of the product use for pregnant women. It is important that your health professional’s advice is followed. The individual results, skin response, performance etc. may vary and the purchaser shall hold us harmless in relation to any damages suffered due to individual results, skin response, performance, error, omission, negligence or under any other cause of action.

The customer acknowledges that neither the service nor any of its agents, affiliates or associates shall be liable for any direct, indirect, incidental or consequential losses related to use of the service or any breach of warranty.
Discounted Codes and Promotions

We may from time to time offer promotional discount codes, which may be applicable to products on the Site or that are otherwise available and must be entered or noted at the

time of submitting your order. The conditions of use relating to any discount code will be specified at the time that it is issued.

Intellectual Property Rights

Intellectual Property Rights mean all present and future rights in or to any patent, copyright, database rights, registered design or other design right, utility model, trade mark (whether registered or not and including any rights in get up or trade dress), brand name, service mark, trade name, eligible layout right, chip topography right and any other rights of a proprietary nature in or to the results of intellectual activity in the industrial, commercial, scientific, literary or artistic fields, whether registrable or not, including all renewals, extensions and revivals of, and all rights to apply for, any of the foregoing rights

We own all Intellectual Property Rights in the Site, business, products, services and branding, as between us and you. The products contain material which is owned by or licensed to us and is protected by Australian and international laws.

You must not breach our Intellectual Property Rights by, including but not limited to altering or modifying any of the Materials, creating derivative works from the Materials or using our Materials for commercial purposes such as on-sale to third parties.
Accuracy of information:

Despite our regular updates to the website and due care and skill, occasionally some information can be inadvertently inaccurate, out of date or incomplete. Product modification and improvement may mean that certain specification about products, descriptions, ingredients, and prices can change without notice in advance.

Your interest in any product until confirmation by us does not guarantee its availability, and we reserve the right to continue, discontinue, change or upgrade any formula at any time without notice.
Jurisdiction and pre litigation requirements:

This agreement is governed by the laws of New South Wales and the parties submit to the non-exclusive jurisdiction of the courts of that state. If a dispute arises between the parties, you expressly agree that you shall not at all defame us on any social media including Facebook, Google, Whatsapp etc. The parties agree to resolve the dispute at first instance through consultation by you informing us through our nominated email: info@elieskin.com

(i) The nature of the dispute;

(iii) The action the you believe will settle the dispute.

We shall endeavor to settle the dispute through viable options acceptable to parties.

Returns and refunds Policy

You may only return the goods purchased within 14 calendar days of the purchase. If 14 days have lapsed since your purchase, unfortunately we cannot offer you a refund or

exchange.

From time-to-time Elie Skin may conduct sale and specials. Only regular priced items may be refunded, unfortunately sale items or items on specials cannot be refunded.

Gift cards if issued by us are non-refundable.

To be eligible for a return, your item must be unused and in the same condition as you received it from us. It must also be in the original packaging. To complete your return, please send the product unused, in original packing with proof of purchase to:

Refunds and exchanges will be processed within 2-3 business days upon receipt. Refunds (excluding the initial postage charge) will be refunded to the original debit/credit card used at the time of purchase.

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of the refund on the product/s received. In the event the refund is rejected on the product/s received by us and you wished to get the product back, the shipment costs may apply to you.

If your refund is approved, then your refund will be processed, and the credit will automatically be applied to your credit card or by way of the original method of

payment, within 14 days of days of our notification to you.

Unfortunately, due to the nature of our products and hygiene reasons we cannot accept returned goods that have been opened and/or used.

Late or missing refunds (if applicable)

If you haven’t received a refund within 14 days of our notification to you, please check your bank account again/credit card again as there may be processing delays. If you still have not received your refund, kindly contact us at info@elieskin.com

Shipping

To return your product, you should mail your product to: PO BOX 5202, Turramurra, NSW 2074, Australia.

You will be responsible for paying for your own shipping costs for returning the item. Shipping costs are non-refundable. If we were required to pay for your shipping costs and you received a refund, the cost of return shipping will be deducted from your

refund.

We collect your name, billing address, delivery address, email address and telephone number. This information must be provided to allow us to effect delivery of the products that you order, and to contact you if necessary. These details are retained in our database for record keeping purposes. Your email address may also be used to contact you in the event that you discontinue a shopping session. We or our service providers may contact you by email to see if there were any problems and if we can help you to complete your transaction.

All personal information held by us will be handled and stored in accordance with our obligations under the Privacy Act. We will take reasonable steps to:

make sure that the personal information we collect, use or disclose is accurate, complete and up to date; protect the information from misuse, interference, loss or unauthorized access, modification or disclosure both physically and through security methods; and destroy or permanently de-identify the information if it is no longer needed for any purpose.

While we implement safeguards designed to protect your information, no security system is impenetrable and due to the inherent nature of the Internet, we cannot guarantee that
